PER COURT :

Petitioner is objecting to E-tender notice issued by the Corporation for awarding work of maintenance of toilet. The principal challenge raised by petitioner is in respect of observance of E-Tender process by the Corporation. According to petitioner, earlier tender process was initiated by the Corporation some seven months back however, the same has been abandoned and as such, it was not permissible for the Corporation to initiate fresh tender process.

The objection raised is devoid of substance. Since the tender work is of the value of more than three lacs, as per the policy prescribed by the State Government, the Corporation is justified in adopting E-Tender process. It is informed that at two places i.e. Amalner and Chalisgaon, tender work has already been awarded whereas in respect of tender work at

wp3218.16.doc Muktainagar, Chopda, Bhadgaon and Pachora, tenders are already opened and those are likely to be finalised within short duration. It is further informed that for two places i.e. Parola and Erandol, tenders are not opened however, the process is continued.
