P.C. :- Present petitions have been filed by brother and sister whose caste validity has been rejected by respondent No.1 on 28.12.2022. 2.

Heard Mr. Dond, learned advocate for the petitioners and Mr. Patil, learned AGP.

The learned advocate for the petitioners after drawing our attention to the genealogy submits that the petitioners had relied upon the validity issued to their cousin Vijay, though there were in fact other

{2} 931 sr.no..odt validity holders in the family. Further, due to ignorance many important documents which can be said to be pre-constitutional, remained to be submitted. He prays that a chance may be given to the petitioners to prove their claim.

Since both the petitioners are students and petitioner Vaishnavi is minor also, it would be in their interest to give them a chance to prove their claim, allowing them to produce the documents, which they want to rely upon, to support their claim. Under such circumstance, the impugned order passed by the respondent No.1 Committee stands set aside. The matter is relegated to the committee. Both the petitioners to appear before the Committee on 1.2.2024. 5.

Respondent No.1 Committee should allow them to produce the documents and thereafter, hold the inquiry and decide the claim of the petitioners, in accordance with law.

Writ petitions stand disposed of.
