Heard learned Counsel for the petitioner. He invited our attention to the order passed by the Home Department, Government of Maharashtra dated 19th July, 2014. He submits that the concerned department has already passed the order thereby ordering release of the petitioner on completion of fourteen years actual imprisonment. It is due to an interim order passed by the Apex Court not to grant remission during the interregnum, the said order was not acted upon. He seeks direction for implementation of the said order in the light of the order passed by the

373.15crwp Supreme Court dated 23rd July, 2015 in Writ Petition (CRL.) No.48 OF 2014 (Union of India vs. V. Sriharan @ Murugan and ors.) modifying the earlier interim order dated 9th July, 2014, by which the State Governments were restrained from exercising power of remission to life convicts. In the light of submission of the learned Counsel for the petitioner and the interim order dated 23rd July, 2015 in case of V. Sriharan @ Murugan and ors.

(supra), we direct the respondents to take an appropriate decision, as expeditiously as possible and preferably within a period of four weeks from today.

The High Court Legal Services Sub Committee, Aurangabad to pay professional fees to the learned Counsel (appointed) for the petitioner, as per schedule of fees. Petition stands disposed of, accordingly.
