Issue notice to the respondent. Learned APP waives notice for respondent - State.Present Application has been filed for getting the delay of 16 days condoned in filing the Appeal. 2.

The applicant is the original accused in Sessions Case No.27 of 2021 who came to be convicted for the offence punishable under Section 326, 307 of the Indian Penal Code by the learned District Judge-2 and Additional Sessions Judge, Amalner on 7th December 2012.

Heard learned Advocate Mr. Patil appearing for the applicant and Mr. Phule appearing for the respondent - State. 4.

Learned Advocate for the applicant submits that there is no literate person in the family of the applicant and due to financial crisis he could not make arrangement and therefore, there is delay of 16 days.

Taking into consideration the duration of delay and the grounds, the Application stands allowed and disposed of. 6.

Registry to verify and register the Appeal.

7.

Appeal stands admitted.

Issue notice in respect of the Appeal as well as Application for suspension of sentence. Learned APP waives notice for respondent State.

In view of the fact that copies of deposition appears to have been filed, copy of the First Information Report be produced on or before next date.

Place the matter for further consideration on 27th October 2023.
