The learned counsel for applicants submits that the period of delay in fling frst appeal can be condoned considering the statutory right of the applicants.

The learned counsel for the respondent strongly opposed the application.

However, for the reasons stated in the application and considering the statutory rights of the applicant, the delay of 289 days in fling frst appeal by the applicants arising out of judgment

2 925 ca 4027-20 and order dated 14/02/2018 passed by the learned Railway Claims Tribunal, Nagpur, is hereby condoned. Civil application is accordingly disposed of.

The appeal be placed for admission, after removal of offce objections, if any.
