The learned counsel for applicants submits that the period of delay in fling frst appeal can be condoned considering the statutory right of the applicants.

The learned counsel for the respondent strongly opposed the application. However, for the reasons stated in the application and considering the statutory rights of the applicant, the delay of 269 days in fling frst appeal by the applicants arising out of judgment
2 926 ca 4028-20 and order dated 07/03/2018 passed by the learned Railway Claims Tribunal, Nagpur, is hereby condoned. Civil application is accordingly disposed of.
