DATE: 20th March, 2018 PER COURT:- 1) The application tendered by the petitioner for awarding LPG distributorship of the Indian Oil Corporation Ltd., at Siddheshwar location in District Hingoli, has been turned down on the ground that the piece of land offered for Godown as well as Showroom has been offered by two applicants, that is, husband and wife. Though the land offered for the Godown consists of a large piece of land, which can be claimed by both the petitioners, however, the area offered for Showroom is a composite plot of 90 sq.mt. and is not partiable.

{2} 903 - WP 2931 of 2018 2) In the circumstances, the decision of the respondent Corporation cannot be faulted. It has been further pointed out that the re-draw has been drawn today and another applicant has been held to be successful at the draw. In view of the subsequent development, the claim of the petitioner cannot be considered.

3) The petitioner is stated to have deposited an amount of Rs.30,000/- with the respondent Corporation and the petitioner claims refund of the said amount.

4) It would be open for the petitioner to tender an application seeking withdrawal of the amount of Rs.30,000/- deposited with the respondent Corporation within a period of four weeks from today. The respondent Corporation shall consider the application and pass necessary orders within a period of eight weeks from the date of receipt of the application.

5) In view of above, writ petition is disposed of.
