Learned Counsel for the petitioner brought to my notice that some of the employees have assailed the common order passed by the Industrial Court, Jalgaon, in Revision Application (ULP) Nos.27 to 49 of 2014 before this Court and the writ petitions so filed by the said employees have been decided by this Court by common judgment delivered on 17th of March, 2016. Learned Counsel submitted that the present petitioner stands at par with the writ petitioners in the aforesaid writ petitions i.e. Writ Petition Nos.917/2016 and the companion writ petitions. Learned Counsel further submitted that in the circumstances, the same order needs to be passed in the

(2) present petition also.

The petitioner has filed on record copy of judgment and order dated 17th March, 2016, passed by this Court in Writ Petition No.917/2016 with companion petitions. Perusal of the aforesaid judgment and order reveals that though this Court has confirmed the order dated 27.11.2015 passed by the Industrial Court in common judgment in Revision (ULP) Nos.27 to 49 of 2014, while disposing of the aforesaid writ petitions, has directed the Municipal Council to pay the retrenchment compensation amount with interest to the petitioners in the manner as provided in paragraph no.30 of the said judgment. In paragraph Nos.30 of the said judgment, the Court has provided the manner in which the retrenchment compensation amount is to be calculated, and also the manner and the time schedule in which the same is to be paid to the petitioners.

On going through the order passed by this Court in Writ Petition No.917/2016 and the companion writ petitions, and on perusal of the contentions raised in the present petition, it appears to me that the same order needs to be passed in the present petition also. Hence, the following order:

ORDER

1) The Writ Petition stands disposed of with direction to the Municipal Council, Bhusaval, to pay to the petitioner the retrenchment compensation with interest, as has been directed by this Court while disposing of Writ Petition No.917/2016, and the companion writ petitions, in the manner as elaborated in paragraph no.30 of the said judgment.

2) No order as to costs.
