The Petitioner is in State Government service. He is apprehensive that he is likely to be terminated on account of a report from J.J. Hospital Mumbai declaring him to be partially blind and making the observation that he is completely and permanently incapacitated for further service of any kind.

The learned AGP raises an objection that this matter has to be filed before the learned Maharashtra Administrative Tribunal, Aurangabad. 3.

Considering the above, this Petition is disposed off with liberty to the Petitioner to prefer an Original Application before the learned Tribunal along with an Application for interim relief. 1/2

Considering the urgency and taking into account the provisions of the Rights of Persons with Disabilities Act, 2016, we request the learned Tribunal to urgently consider the interim Application of the Petitioner for adinterim protection, on it's own merits.
