Learned Counsel for the petitioner, upon instructions, seeks leave to withdraw the instant petition. 2.

Liberty, as prayed for, is granted in the interest of justice.

The Sessions Judge, Jalna, vide order dated 11th March, 2015, has passed an order to the effect that, the 28 cheques mentioned in the application be referred to the Director, Forensic Science Laboratory, for determining the age of the signature, stamp of firm of accused, the stamp of date on

WP376.2015 -2the above said cheques. Learned Counsel for the petitioner fairly submits that, till this date, the writ has also not been issued.

This Court, in the interest of justice, would direct the learned Magistrate seized with the matter in S.T.C. No. 888 of 2013, shall make an endeavour to execute the order passed by the Sessions Judge, Jalna, within two weeks from today. The Director, Forensic Science Laboratory, is requested to make an endeavour to submit the report to the Court of learned Magistrate as far as possible within three months from the date of receipt of the cheques. In the eventuality that the endeavour fails, the Director, Forensic Science Laboratory, shall request the Court for extension of time. It is made clear that, all contentions of the complainant are kept open. 5.

With these directions and observation, the writ petition stands dismissed as withdrawn.
