1] Heard learned counsel for the applicant and the learned APP for the respondent-State.
2] The applicant is apprehending arrest in connection with FIR No. 0088/2025, registered with Selu Police Station, Dist. Parbhani, for the offence punishable under Sections 108, 74, 351 (2), 351 (3) and 3 (5) of the BNS.
3] The case against the applicant is that on 25.02.2025 when the victim was watering to the new construction, the applicant went there and with ill intention he held her hand. The deceased mentioned that she would inform the incident to her parents, at that time, the applicant threatened that he knows about her relations with Rajesh Shelke, and she should keep relation with
413.25ABA applicant also, otherwise he will defame her and he will not allow to fix her marriage. Thereafter, the deceased mentioned this fact to the father and committed suicide. 4] Prima facie, it appears that the applicant threatened the victim that he knows about her relations with other person and the applicant was seeking sexual favour from the victim threatening her he will defame her in the society. Due to harassment of the applicant, the deceased has committed suicide. This is a case of sexual exploitation by the applicant leading the victim to commit suicide. Therefore, this is not a case to grant anticipatory bail. Hence, the present application is dismissed. 5] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall not be influenced by the observations of this Court while deciding regular bail or at trial.
