In all these matters it is not disputed by

2 wp 4164.18+ the respondents that the land of the petitioners are under acquisition.

Mr. Dande, learned counsel for the respondent submits that the possession has not yet been taken. It is further submitted by the learned counsel that twice the negotiation had taken place with the petitioners, however the same could not fructify.

If the land is not acquired by negotiation within a period of six months from today, then after the lapse of six months the respondent shall initiate acquisition proceedings as per the provisions of the Maharashtra Industrial Development Act, 1961 and the same shall be concluded expeditiously and preferably within a period of one year from the start of acquisition proceedings.

It is also open for the respondents to take decision with regard to deletion of the petitioners land from acquisition.
