The application is filed for grant of leave to file appeal against judgment and order of Special Case No. 97 of 2011 which was pending in Special Court, Dhule. In a case filed for offences punishable under sections 7, 13 (1) (d) read with 13 (2) of Prevention of Corruption Act, 1988 the Respondent is acquitted by the trial Court. 2.

Seen the record. The trap was successful and the money was recovered from the custody of the accused. It appears that the trial Court has considered two circumstances like the work of complainant was already

-:(2):- done and on that ground the acquittal is given. This Court holds that there is arguable case for the State. So, the application is allowed. Leave is granted. 3.

Appeal is admitted.

Comply the provisions of Section 390 of Cr.P.C. 5.

Send back the papers to the trial Court for preparing paper book.
