This Court, on previous date, i.e. 11.02.2025, passed the following order:- Learned Advocate appearing for the appellant submits that, both the parties have approached the concerned Family Court and have filed Petition for Divorce by mutual consent. He submits that, he will withdraw this appeal on the next date without fail, as he has to receive written instructions from the appellant. Stand over to 17th February 2025.

Learned counsel for the Appellant tenders across the bar a copy of the application filed under Section 13(B) of the Hindu Marriage Act, 1955, in respect of his contention that the parties have appeared

9-fca21.2023 before the Family for divorce by mutual consent. The same is taken on record and marked as "X". Learned counsel for the appellant, on instructions, seeks leave to withdraw the Appeal in view of pendency of the said divorce petition for mutual divorce. 4.

In view of the above, the Appeal stands disposed of as withdrawn.
