Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant is seeking bail in Crime No.171 of 2022, registered with Parner Police Station, District Ahmednagar, for the offences punishable under Sections 395, 329, 397, 364, 341, 504, 506 of the IPC.

3. It is the case of irregular overtaking the vehicle that converted into assault. The injured has alleged that around six persons assaulted him. The applicant and co-accused snatched the golden ornaments and cash of Rs.60,000/- from his pocket. However, nothing is recovered from the applicant. The alleged

golden ornaments have been recovered in the crime from coaccused. 4.

Learned counsel for the applicant would submit that before the alleged incident, the applicant was met with road accident and suffered the serious injuries. For that injuries, he is under treatment. However, there were no serious injuries in the incident. Now, he is taking rest and treatment at his home. There is no danger to his life.

Learned APP would submit that he has suffered serious injuries in the incident and he is under treatment. 6.

There is no evidence or material before the Court that his life is in danger. The recovery of the alleged ornaments has been done. Nothing is recovered from the applicant. There are no antecedents to his discredit. The trial may take its time, as the injured may not be able to attend the Court. Hence, it is inappropriate to keep him behind bar. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant AMOL @ BABU MADHAV ROHOKALE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.171 of 2022, registered at Parner Police Station, District Ahmednagar, for the offences punishable under Sections 395, 329, 397, 364, 341, 504, 506 of the IPC, on the following conditions :

(a) The applicant shall not tamper with the prosecution witnesses.

(b) He shall not involve in a similar crime.

(c) He shall attend the trial on each effective date.
