PER COURT :- 1.

The petitioner is objecting to finalization of the Development Plan for Ahmednagar Municipal Corporation. The petition was tendered before according final sanction to the Development Plan by the State Government.

Rule was granted on 7th December, 2004. This Court, in its order dated 27th January, 2005, has observed that petition is premature one. Apart from this, it has been pointed out that the final development plan has been sanctioned by the State Government after calling for objections once again in the year agp/-

BENCH AT AURANGABAD (2) WP NO.5459/2004 2002. The date of according sanction by the State Government to the final development plan is 4th July, 2005. It is also informed that some portion, which was excluded from the final Development Plan, has been directed to be included after adopting procedure prescribed under the Maharashtra Regional and Town Planning Act in the year 2003.

In view of the subsequent developments that have occurred after filing of this petition, the instant petition is rendered infructuous.

The writ petition, as such, stands rejected.

Rule discharged. No order as to costs.
