Heard the learned counsel for the applicant, the learned A.P.P. for respondent No.1/State and the learned counsel for the complainant. 2.

The role attributed to the applicant that he had provided a room to the main accused and he was in touch with the main accused on telephone. There were about 32 calls between the applicant and the main accused.

The learned counsel for the complainant strongly opposed the application contending that the applicant is not entitled to parity as his role is altogether different from the role attributed to the co-accused Baban Fakirrao Wagh, who has been granted bail.

Considering the role attributed to the applicant and the completion of the investigation against him, the Court is of the view that it would be inappropriate to keep the applicant behind bar. He may be granted bail on certain conditions. Hence, the order :- (i) The application is allowed.

(ii) Applicant Bhagwan Sahebrao Sormare be released on bail on furnishing P.B.and S.B. of Rs. 50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in C.R.No.375 of 2022 registered with Police Station Karmad, Taluka and District Aurangabad, for the offences punishable under Sections 363, 364A, 386 and 506 read with Section 34 of the Indian Penal Code, on the conditions that, (a) He shall not tamper with the prosecution witnesses. (b) He shall not involve in the similar crime. (iii) Criminal Application No. 1003 of 2023 stands dispose of. ( S. G. MEHARE ) JUDGE ysk
