I do not find any substance in this writ petition. 2.

Petitioner-defendant has filed an application Exh.41 before the Trial Court for impounding of the document Exh.26. Said document Exh.26 is an agreement of sale without delivery of possession. The learned Judge of the Trial Court, has, therefore, rightly observed that compulsory registration of such a document wherein possession is not delivered is not necessary in view of the provisions of Section 17 of the Indian Registration Act.

I do not find any fault in the impugned order. Writ Petition is devoid of any merit. Writ Petition is hereby dismissed. No costs.
