I went through the judgments of both the Courts below. I heard the submission at the bar. I found that the impugned judgment passed by Additional Sessions Judge, Nilanga is correct appraisal of facts and the law relating to the subject. He rightly observed that the applicants who are respondents here had ample reason to make this application under the provisions of the Protection of Woman from Domestic Violence Act 2005. Their grievance was that the petitioner who are their family members were obstructing their cultivation of certain land which was allotted to their share. 2.
Learned Sessions Judge rightly observed that due to dispute in the family bitterness could have developed between the parties. Due to such difficulty, the
( 2 ) crirevnapln79.14 applicants could have tried to over power the respondents. Cultivation of agriculture land is labour intensive. A weaker party can easily be obstructed and cowed down by its adversary who has more physical power. The impugned order does not suffer from any illegality.
