The present applicant, who is arrested by Ambajogai Rural Police Station, Dist. Beed in Crime no.148 of 2011 for the offences punishable under section 395, 397 of the Indian Penal Code r/w. Section 3(1), 3(2), 3(4) of the Maharashtra Control of Organized Crimes Act, is praying for his release on bail.

The prosecution case would show that in the night between 20/11/2011 and 21/11/2011, 5-6 unknown dacoits have entered the house of the complainant and took away the valuables and cash.

It appears that, during investigation, recovery of two articles on the same date were made by the present applicant of the property involved in the offence.

In the circumstances, no case is made out for release of the applicant on bail. The Application is therefore dismissed.

However, since the applicant would be an under-trial prisoner, the concerned Court is directed to expedite the hearing in the matter.
