The learned advocate places on record the order of the Appellate Court dated 03.11.2012 to indicate that the said appeal has been dismissed in default 07 years ago and there has been no application for restoration.

The learned advocate for the petitioner submits that the statement of the respondent may be recorded and the copy of the order of the Appellate Court may be taken on record.
