Perused the pleadings in the petition, annexures thereto, and the reply filed by respondent No.2 with annexures. It appears that the petitioner proceeded to file writ petition on the basis of merit list making grievance that though the petitioner has secured 129 marks from the OBC General category, less meritorious candidates from the said category have been selected. In reply to the assertion of the petitioner that less meritorious candidates than the petitioner from OBCGeneral category have been selected, the learned Counsel for the respondent No.2 invited our attention
3283.15wp to the contents of the affidavit-in-reply and also the list published on 20th January, 2015 wherein, in detail, categories are mentioned. According to the Counsel for respondent No.2, the candidates from OBC Project Affected category are selected since cut-off marks for the said category were "126". The petitioner is from OBC-General Category, wherein the cut-off is 144 marks.
In that view of the matter, we do not see reason to entertain the petition. Hence petition stands rejected.
However, it will be open for the petitioner to verify the list of selected candidates published by the respondent No.2 on 28th January, 2015 and in case, the statement made in the reply filed by respondent No.2 is incorrect, to pray for review.
