IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 12 WRIT PETITION NO.5009 OF 2022 CHHAVA JANKRANTI SANGHATNA MAHARASHTRA THROUGH ITS PRESIDENT SHARAD UKHA PAWAR PATIL
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ....
Mrs Alka Tanaji Shelke, Advocate for petitioner; Mr S. G. Sangle, A.G.P. for respondents/State CORAM : RAVINDRA V. GHUGE AND ANIL L. PANSARE, JJ.
DATE : 20th June, 2022 PER COURT:
1.
On 06/06/2022, this Court (Coram : R. D. Dhanuka and Anil L. Pansare, JJ.) had passed the following order :- 1.
The learned AGP for the respondents/State seeks time to make a statement about maintainability and as to when fresh complaint filed by the complainant would be considered.
2.
Place the matter on board on 20-06-2022.
2.
Today, when called upon, the learned Advocate for the petitioner submits that, the petitioner is a social organization and they cater to the needs of the farmers.
5009.22wp (2) 3.
We have perused paragraph Nos.6, 7 and 8 of the petition, which are specifically pointed out to canvass that, some of the officers of the APMC are indulging in malpractices. There are vague allegations.
4.
Across the bar, we are informed that the petitioner has already instituted a civil suit on behalf of some of the farmers. Some orders have been passed in the civil suit. The petitioner would be taking recourse to the available legal remedies with reference to such orders.
5.
In view of the above, we do not find that this writ petition deserves to be entertained and more so, when it is not a public interest litigation. This petition is, therefore, disposed off. (ANIL L. PANSARE, J.) (RAVINDRA V. GHUGE, J.) sjk
