The petitioner is claiming benefit of the scheme of the Government vide Government Resolution dated 10.01.2006, whereby the convicts who is more than 65 years and having undergone actual imprisonment of 14 years are entitled to premature release. 2.

Learned APP tenders across the bar the written communication received by him from the Superintendent of Nashik Central Jail dated 11.04.2023 inter alia mentioning about the petitioner being aged more than 65 years and having actually suffered sentence for 14 years is entitled to the benefit. He was produced before the medical board for certification of his age and decision would be taken no sooner the report is received from the Civil Hospital Nashik certifying his age.

Learned APP also submits that in any case orders would be passed in respect of the petitioner, as expeditiously as possible, after receipt of the report from the civil hospital and in any case within four weeks. We direct accordingly and disposed of writ petition.
