By the present Application, the legal heirs of the Appellant have prayed for condonation of delay of 2224 days caused while filing the Application for bringing the legal heirs of the Appellant on record, setting aside the abatement and seeking permission to bring them on record as legal heirs of the Appellant. 2.

The learned counsel for the Acquiring Body fairly raised no objection. Therefore, considering the subsistence of

(( 2 )) 951(B)-CA-5344-2024 cause and the grounds set out for the delay, the delay of 2224 days are hereby condoned, subject to payment of cost of Rs.1,000/-, to be paid in the account of 'Creche / Day Care Centre', Advocates' Association of Bombay High Court, Bench at Aurangabad, on or before 21.03.2025.

Accordingly, the abatement is set aside. The Applicants are permitted to bring them as legal heirs of the Appellant on record. Necessary amendment be carried out on or before 21.03.2025 after production of receipt with the office.
