Heard the learned advocate for the petitioner as also the learned A.P.P. 2.

The petitioner is before us with a limited prayer, seeking a direction to the trial court to pass appropriate order on his application, seeking further investigation under Section 173(8) of the Code of Criminal Procedure. 3.

It is being pointed out that the prosecutor's say was also solicited. He has expressly consented and further solicited appropriate order in the light of decision in the matter of Venubhai Haribhai Malaviya Vs. State of Gujarat and Anr.; 2019 A.I.R. (Supreme Court) 5233.

We dispose of the Criminal Writ Petition by requesting the trial court to decide the petitioner's application filed under Section 173(8) of the Code of Criminal Procedure, as expeditiously as possible and in accordance with law.
