The claimants alongwith their Advocate Ms. Asha D. Rakh, are present. Mr. B. R. Surwase, learned counsel for appellant / acquiring body alongwith Mr. Dhananjay Shastri, Deputy Engineer, Jalna Minor Irrigation Division, Jalna, are present. The parties have arrived at compromise. The claimants relinquished their right over compensation towards the fruit bearing trees. The compromise pursis is filed on record. The same is taken on record and marked as 'X' for the purpose of identification. The claimants have already withdrawn 50% amount of compensation.

302 FA.1043.2024.odt The trees' compensation is to be refunded to the acquiring body alongwith interest. The remaining amount alongwith interest be disbursed to the claimants.

The appeal stands disposed of. The award be prepared in terms of compromise.

The civil application/s, if any, except the application to bring on record legal heirs, stand/s disposed off.

The Court Fee refund Certificate be issued as per the Rules.
