IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 8279 OF 2016 MUNICIPAL COUNCIL, CHOPDA VERSUS RAMESH PUNDLIK BAVISKAR ...

Advocate for Petitioner : Shri Patil Pradip R. ...

CORAM : RAVINDRA V. GHUGE, J.

Dated: December 20, 2016 ...

PER COURT :- 1.

The petitioner is aggrieved by the judgment dated 23.12.2015, delivered by the Labour Court, Jalgaon in Complaint (ULP) No.4 of 2013. 2.

The petitioner has an efficacious, expeditious and statutory remedy of filing a Revision Petition under Section 44 of the Maharashtra Recognition of Trade Unions and Prevention of Unfair Labour Practices Act, 1971. This Court in the matter of Engineering Employees Union Vs. Devidayal Rolling & Refinery Pvt. Ltd. [1986 (52) FLR 40 = 1986 Mh.L.J. 331], has concluded that a Writ Petition should not be entertained unless the remedy of revision petition is exhausted. 3.

In the light of the above, this petition is disposed off so as to enable the petitioner to prefer the Revision Petition before the Industrial Court, Jalgaon.
