BENCH AT AURANGABAD WRIT PETITION NO. 8274 OF 2016 Tanaji S/o Bhaurao More

...Petitioner

Versus

The State of Maharashtra and Ors.

...Respondents

Mr. S.S. Choudhari, Advocate for Petitioner Mr. S.G. Karlekar, Assistant Government Pleader for Respondent Nos. 1 to 4 CORAM : S. V. GANGAPURWALA & A. M. DHAVALE, JJ.

DATE : 27th FEBRUARY, 2019 ORAL ORDER:

1.

We have heard the learned Counsel for the petitioner and learned Assistant Government Pleader.

2.

It appears, for the same relief, earlier Writ Petition bearing No. 8156/2013 was filed. This Court under order dated 08.10.2013 observed that the matter raises disputed questions of facts and so, the Court is not inclined to interfere in the writ jurisdiction. The petitioner was given opportunity to take other steps. Thereafter, the petitioner filed Writ Petition No. 6772/2015 for the same relief. This Court under order dated 13th July, 2015, observed that the identical relief claimed in Writ Petition No. 8156/2013 has been disposed of by the Court. In view of that, the Second Writ Petition would not be maintainable.

3.

Now, the petitioner has filed third Writ Petition for the same relief. Such prayer when the same was already a subject matter in the

2 65-WP-8274-2016 earlier Writ Petitions and were not granted, cannot be considered in the present Writ Petition.

4.

The Writ Petition is accordingly disposed of. No costs. [ A. M. DHAVALE ] [ S. V. GANGAPURWALA ] JUDGE JUDGE mta
