This is the Application for condonation of 798 days delay in preferring First Appeal against the Judgment and Award dated 05.10.2019 passed by the learned Reference Court in L.A.R. No.4/2014. 2.

Pursuant to notice issued to the Respondents, the learned Advocate appears for Respondent No.1 and the learned AGP appears for Respondent No.2.

The learned Advocate for the Applicant submits that due to financial constraints and drought situation in the area where the Applicant is residing, he could not approach this Court within the prescribed period. He submits that the Application be allowed.

The Application is opposed by the learned Advocate for the Acquiring Body and the learned AGP. They submit that, no sufficient reasons are mentioned in the Application.

Perused the Application. For the reasons mentioned in paragraph no.3 of the Application, the Application is allowed in terms of prayer clause 'B', subject to the condition that the Applicant / Appellant shall not be entitled for the statutory benefits and the interest for the said delayed period. Civil Application stands disposed of accordingly. 6.
