State has preferred instant application for condonation of 03 days delay cause in filing application seeking leave to file appeal against the judgment and order of acquittal passed by learned Special Judge (P.C. Act) (Court No.6), Aurangabad in Special Case (ACB) No. 18 of 2016 dated 28.08.2023.

Learned APP attributes the delay to administrative decisions and procedural delays. He further submits that State has a good case on merits in appeal and hence, he seeks condonation of delay.

Learned counsel for the original respondent strongly opposed pointing out that there is no plausible explanation for the delay and administrative delay is not a good ground to condone the same. 4.

In the interest of justice, the application is allowed and the delay of 03 days caused in filing the leave application is condoned. Registry to register the application.
