The learned counsel submits that the petitioner is appointed on 27.11.2017 and the proposal is submitted by the employer. The validation proceeding is not yet decided and the appointment order states that if within six (6) months the validity is not submitted, his services will be terminated.

To get the validation proceeding decided within the stipulated period is not in the hands of the petitioner. It is submitted that even

( 2 ) wp 3128.18 vigilance is not yet conducted.

Considering the above we pass the following order. 3.

The Respondent No. 2- Committee, shall decide the validation proceeding in respect of the tribe claim of the petitioner within a period of eight (8) months from the date of the appearance of the petitioner. The petitioner shall appear before the Committee on 03.04.2018. The Respondent Nos. 1 and 2 shall not take any adverse action against the petitioner only on the ground that the validation proceeding is pending. The Respondent Nos. 1 and 2 can take further course of action depending upon the judgment that would be delivered by the Committee. The writ petition is disposed of. No costs.

The petitioner shall co-operate in expeditious disposal of the validation proceeding.
