PER COURT :- 1.
Learned counsel for the applicant submits that the sole bread winner of the family met with an accidental death and due to financial constraints the applicants could not file the appeal within period of limitation.

Learned counsel for respondent strongly resisted the application on the ground that the delay has not been explained satisfactorily.

In view of the submissions made on behalf of the applicants and for the reasons stated in the application, delay of 119 days caused in filing first appeal is hereby condoned. Civil application is allowed and accordingly disposed of.

In appeal, issue notice to the respondents, returnable on 7.4.2017. Learned counsel waives notice for respondent No.1 MSRTC.
