Heard the learned advocate for the petitioner as also the learned AGP.

Though it is an innocuous prayer inasmuch as an order passed by the District Magistrate under Section 14 of the SARFAESI Act is being sought to be implemented/executed, the things are not as fair.

The order under Section 14 was passed on 12.12.2019, and in spite of the petitioner being a nationalized

(( 2 )) 934-WP-4445-2025 bank, for whatever reasons, it could only find the time to approach this court seeking execution of that order after more than five and a half years. The very purpose of providing a special status to financial institutions is undermined by such delays in undertaking recoveries, despite the fact that the law is devised to assist financial institutions. 4.

Be that as it may, the writ petition is disposed of directing the respondent No.3 District Magistrate/Collector and respondent No.4 Executive Magistrate/Tahsildar, to execute the order passed by the District Magistrate dated 12.12.2019, as expeditiously as possible and in any case within four weeks.
