Admittedly, respondent No.2 - Education Officer (Secondary), Zilla Parishad, Jalna was not a party to the compromise, which was arrived at between the other parties to the appeal before the School Tribunal. By way of filing this writ petition, the petitioner is seeking mandatory directions to respondent No.2 to process the salary bills of back wages payable to the petitioner and release the
3845.16wp grants-in-aid for disbursement of salary.
Since, the Education Officer - respondent No.2 was not a party to the said compromise, we are unable to persuade ourselves to entertain this petition and issue mandatory directions to respondent No.2.
In that view of the matter, petition stands rejected.
However, if there is any compromise, the petitioner can enforce the terms of the said compromise against the parties who have signed the compromise. In that respect, we have not expressed any opinion.
At this stage, learned Counsel for the petitioner makes an oral prayer to withdraw the petition. We reject the said prayer.
