Applicant is convicted under Section 279 of the Indian Penal Code and is sentenced to suffer Rigorous Imprisonment for three months and to pay fne of Rs. 500/-, in default to suffer Rigorous Imprisonment for 15 days. He is also convicted under Section 304-A of the Indian Penal Code and is sentenced to suffer Rigorous Imprisonment for two years and to pay fne of Rs. 1,000/-, in default to suffer Rigorous Imprisonment for three months.

- 2 - Applicant has also been convicted under Section 134 read with Section 187 of Motor Vehicle Act and is sentenced to suffer Rigorous Imprisonment for one year and to pay fne of Rs. 100/-, in default to suffer Rigorous Imprisonment for 7 days.

Considering the quantum of sentence, following order is passed :-

ORDER

i) Application is allowed.

ii) Substantive sentence is suspended till disposal of the revision.

iii) Applicant be released on PR Bond of Rs.15,000/- (Rs. Fifteen Thousand) with one solvent surety in the like amount.

iv) Bail before the trial Court.

v) Application stands disposed of.
