This application is pressed into service praying for early hearing of Criminal Appeal bearing no.176 of 2012, which is arising out of judgment and order passed by the learned Additional Sessions Judge, Ahmednagar on 30-07-2011.

Learned Advocate for the applicant submits that applicant is due to retire next year and therefore, his matter be taken up for early hearing.

Learned APP points out that this Court is currently dealing with matters of the years 2003, 2004 and 2005 and therefore, he prays to dismiss the application.

This Court is dealing with matters of the years 2003, 2004, 2005. No doubt only in exceptional case, on finding sufficient cause, matter will be taken up out of turn for early hearing. In the present case, no good ground is made out for taking up matter for out of turn hearing. Therefore, matter will be taken up as per its turn. 5.

Application is rejected and disposed of.
