This is an application for modification of condition imposed by this Court vide order dated 09th September, 2020, wherein the applicants were directed to attend the concerned Police Station once in a week, i.e. on every Sunday between 08:00 a.m. to 11:00 a.m. till the filing of charge-sheet. 2.

Learned advocate for applicants submitted that the applicants were granted bail in Crime No.103 of 2020 and the aforesaid condition was imposed. The applicants have complied with the said condition. The charge-sheet has not been filed. There are no other criminal antecedents against the applicants. Hence, the condition No.II[b] reflected in the order dated 09th September, 2020, may be relaxed.

Learned APP submitted that the condition was imposed

903-CrA-699-21.odt with some purpose. The offence committed by the applicants is punishable under Section 302. There is no dispute that the applicants had attended the concerned Police Station in compliance with the order dated 09th September, 2020. Although one year is passed after granting bail, charge-sheet has not been filed. In these circumstances, there is no impediment in relaxing condition No.II[b] stipulated in the order dated 09th September, 2020.

ORDER

(i) Order dated 09th September, 2020 is modified and the condition that 'the applicants shall attend the concerned Police Station once in a week i.e. on every Sunday between 08:00 a.m. to 11:00 a.m. till filing of the charge-sheet' is relaxed.

(ii) The application is disposed of.
