Present applications have been filed by the State for getting delay of 1307 days condoned in filing first appeals. The State intends to challenge the judgment and award passed by the learned reference Court.

Learned Advocate appearing for the respondents - claimants strongly opposed the applications on the ground that there is huge and inordinate delay which has not been explained properly.

Though there is strong objection, however,

(Order) (2) C.A. No. 5622 of 2019 & Group yet, for the reasons stated in paras no.02 to 04, the delay is hereby condoned. Applications stand allowed and disposed of accordingly. Registry to verify and register the first appeals and place them for consideration on 14th November 2019.

Though stay applications have been disposed of with conditional order, it appears that the State has not deposited the decretal amount. Learned Assistant Government Pleader makes a statement that he would pursue the concerned authorities to deposit the amount within a period of six weeks. It is expected that the learned Assistant Government Pleader should convey it to the concerned authority that they are duty bound to deposit the amount within the aforesaid period.
