Learned Advocate for the respondent Union submits that the State has issued a GR dated 30/03/2000 in favour of identically placed workers from the same Seeds Farm. Pursuant to the impugned judgment of the Industrial Court dated 25/07/2000, the members of this Union, who were before the Industrial Court, were treated on parity. However, since November 2001, they are not in employment with the petitioners. It is also pointed out that this Court had passed a reasoned order on 20/04/2004 concluding that the petitioner shall employ the said workmen as and when work is available as per the seniority list.

Considering the above and taking into account the stand taken by the petitioners with regard to such daily wage workers by GR khs/AUGUST 2018/4339-d

dated 30/03/2000, this petition is disposed of. It is expected that the petitioners would comply with the directions of this Court dated 20/04/2004 and would treat the similarly situated daily wagers, alike in view of its policy declared through the GR dated 30/03/2000.

In the event the employees covered by the ULP complaint at issue, make the representation to the petitioners within 4 weeks from today pointing out any unpaid daily wages in tune with the GR dated 30/03/2000, the petitioners shall consider the same and in the event of any unpaid amounts, shall proceed to make the said payments within 12 weeks thereafter.
