PER COURT :- The petitioner is praying for issuance of directions to respondents No.2 to 4, to hold an enquiry, in respect of alleged substandard work of construction of road, carried out by the contractor through M.S.R.D.C. Limited.

It has been informed by MSRDC that, the total damages are to the extent of 0.12% and the defects pointed out are quite negligible. Apart from this, the defect liability period, prescribed under the terms of tender, is of three years and the contractor is obliged to ratify the defects, if any.

{2} wp 4064.15.odt In view of the explanation tendered by the MSRDC, in our opinion, no cognizance of the instant petition, need be taken, in exercise of extra ordinary jurisdiction under article 226 of the Constitution of India.
