The learned counsel for the petitioner submits that validation proceeding is pending since 2013. The vigilance is conducted and reply to the vigilance report is also filed. However, the same is not decided. The employer has issued notice.

The learned Assistant Government Pleader accepts notice for all respondents.

The Respondent No 1 shall decide the validation proceeding in respect of tribe claim of the petitioner expeditiously and preferably within a period of three (3) months from the date of the appearance of the petitioner. The petitioner shall appear before the Committee on 03.04.2018. The Respondent No. 2 shall not take any adverse action against the petitioner, only on the ground that the validation proceeding is pending. The Respondent No. 2 can take further course of action depending upon the judgment that would be delivered by the Committee in the validation proceeding. The writ petition is disposed of. No costs.
