The learned Counsel for the respondent No.3 submits that the order which is assailed in this petition was subject matter of Writ Petition No.5522/2012 before the Bench presided over by the learned Single Judge wherein a statement was made by the learned Counsel for the petitioner that in view of the subsequent events, the petition has become infructuous and accordingly, the said petition was disposed of.

3898.12wp Apart from the fact that the petition is already disposed of as infructuous, even on merits, we do not find any reason to interfere in the impugned order. The 9.75 marks assigned to the petitioner were contrary to the instructions issued at the highest level of the Government. In fact, more than 9 marks could not have been given. Therefore, even on merits, the petition sans merits and the same stands rejected.
