PER COURT :- 1) The applicant has filed the present criminal application, seeking condonation of delay, which has occurred in filing Criminal Application seeking leave to file an appeal under Section 378(4) of Code of Criminal Procedure. The delay occasioned is of 7 days. The Learned Counsel for the respondent has opposed for condoning the delay.
2) The delay occasioned in filing the application is only of 7 days. The applicant has provided sufficient reasons there for. As such, I am inclined to allow the present application. Hence following order.
i) The delay occasioned in filing the Criminal Application seeking leave to file an appeal is condoned;
ii) Criminal Application seeking leave to file an appeal be listed for hearing on merits.
