This matter was heard at length on 23.7.2018. It was proposed to the litigating sides as to whether these contesting parties would maintain status quo with the available suit land till August 2019, so as to enable the trial Court to decide RCS No.40 of 2016. An adjournment was sought to collect instructions.

Learned counsel for the petitioners submits, on instructions, that out of 6 acres and 6 ares land from Gut No.49/1, these four petitioners have sold 93 Ares land in 2016. They do not intend to alienate the said 4 Acres land till August, 2019. They also do not intend to alienate the land admeasuring 1 hectare 1 are in Gut No.49/4. 3.

BENCH AT AURANGABAD 2 - WRIT PETITION NO. 5060 OF 2017 order dated 4.2.2017 would bind the litigating sides to the extent of about 4 acres land from Gut No.49/1 and 1 hectare 1 are land from Gut No.49/4 that remains in the possession of these petitioners, till the suit is decided. The trial Court shall decide RCS No.40 of 2016 on/or before 31.8.2019. The litigating sides would refrain from seeking unnecessary adjournments and shall extend their cooperation to the trial Court.
