Mr. Dharurkar, learned counsel for petitioners submits that though the Award has been passed, the possession has been taken prior to issuance of Section 4 Notification.

The petitioners are entitled for rental compensation. The application has been filed by the petitioners, but the same is not decided.

Mr. Karlekar, learned A.G.P. submits that application has not been made to the Land Acquisition Officer by petitioners.

The petitioners may make an application to the Special Land Acquisition Officer / Competent Authority for grant of rental compensation.

On receipt of the application for rental compensation the Special Land Acquisition Officer / Competent Authority shall take decision upon it on its own merits, in accordance with law, after hearing all parties concerned, expeditiously and preferably within a period of nine (09) months. 5.

Writ Petition is disposed of. No costs.
