By the present application, the applicant/original respondent/wife in Criminal Writ Petition No. 81 of 2022 prayed for permission to withdraw the maintenance amount which has been deposited by non applicant/original Petitioner husband. 3.

On the face of record, it appears that the present non applicant had filed Criminal Writ Petition No. 81 of 2022 and challenged the judgment and order dated 02.12.20221 passed by the learned Additional Sessions Judge, Parbhani in Criminal Revision No. 75 of 2017 arising out of the judgment and order dated 03.05.2017 passed by the learned JMFC, Court No.3,

903appln1160-24 Parbhani in Criminal Misc. Application No. 596 of 2014. 4.

The present non applicant/petitioner has deposited the maintenance amount before this Court and as such, the said writ Petition came to be disposed off on 03.04.2023, as such, it would be just and proper to permit the applicant wife to withdraw the maintenance amount as prayed.

In view of the above, the applicant is permitted to withdraw the maintenance amount deposited in this court. Accordingly, the Criminal application is disposed off. ( Y. G. KHOBRAGADE, J. ) JPChavan
