Mr.Bajaj, learned Counsel for the applicant submits that he has served a copy of this application to respondent no.2 - Hiralal s/o.

2 12-CA-4006-17.odt Motilal Desarda and has intimated him about today's circulation of the matter.

Mr.Bajaj, learned Counsel submits that earlier also, after disposal of the Writ Petition, similar applications were filed seeking permission to allot the land to Weights and Measurement Department and also to the Maharashtra University of Health Science. At the time of adjudicating the said applications also, respondent no.2 had not appeared before the Court.

Mr.Bajaj submits that by the present application, permission is sought to allot the land to M.S.E.D.C.L. for the purpose of establishment of 33/11 K.V. proposed sub-station behind rural Police Office, Near T.V. Centre, CIDCO, Aurangabad. The same is meant for public purpose.

Considering the fact that the land would be used for public purpose by M.S.E.D.C.L., we

3 12-CA-4006-17.odt allow the present Civil Application in terms of prayer Clause (B). The land be allotted by adopting the proper procedure. The Civil Application stands disposed of accordingly.
