Learned A.P.P. submits that the applicant has assaulted on the head of the informant with blunt side of a sickle. According to learned A.P.P. it was an attempt on life of the informant. Injury certificate indicates him to have suffered injuries grievous in nature. She, therefore, urged for rejection of the application.

The applicant is more than seventy years of age. The injury certificate issued by the government hospital indicates the informant to have suffered injuries simple in nature. He takes discharge against medical advise. 1 / 2

913-ABA-367-23.odt He got admitted to a private hospital and has now come with an injury certificate indicating injury grievous in nature. The injury certificate is not supported with any other documents such as CT scan, x-ray, etc. 4.

In view of same, order dated 30th March, 2023 granting the applicant interim anticipatory bail is hereby made absolute. The applicant shall appear before the investigating officer, as and when required for the investigating purpose. The applicant shall not tamper with the prosecution evidence.
