We have heard Mr. Gaware, the learned advocate for the petitioner and Mr. Deshpande, the learned A. S. G. for respondents/Union.

We would entertain present petition only to the extent of prayer that the application of the petitioner for grant of Industrial Entrepreneur Memorandum (I.E.M.) be considered afresh and be decided.

As far as other reliefs with regard to the bank guarantee are concerned,, it is for the respondents to take appropriate decision on its own merits. The petitioner may represent with

Mr. Gaware, the learned counsel further submits that, fresh proposal for issuance of I.E.M. to the petitioner is made with the respondents on 12.02.2020. The petitioner may deposit the amount as is required under the rules and the procedure with the respondents. Upon deposit of the amount as required, the respondents may consider the proposal of the petitioner for issuance of I.E.M. on its own merits and in accordance with law. 5.

The petitioner may agitate with regard to its bank guarantee with the respondents as may be permissible. The respondents may consider the proposal given by the petitioner for issuance of I.E.M. (page 90) as a fresh proposal. 6.

In the light of the above, the writ petition is disposed of. No costs.
